If you have been arrested for a DWI, you have fifteen days to request your ALR hearing. This is a hearing to determine whether or not DPS is going to suspend your license for refusing to submit a specimen of your breath or blood. It’s an important hearing even if you lose the hearing; it’s important because we get the officer subpoenaed to this hearing. We get to cross examine him on all the aspects in the details of the case and we have a better shot when we go into a trial knowing exactly how he is going to testify because we have had to benefit of hearing it before the trial.
